This document establishes the terms and conditions that regulate the access and use of the MIL&UN VERD Website as well as the purchase or acquisition of its products and/or services and are applicable to all users of the Website. Please read these Terms and Conditions of Sale carefully.
MIL&UN VERD disclaims any liability arising from users' failure to comply with any of the Website's Terms and Conditions and rules of use. You recognise and accept that the Website's Terms and Conditions of Sale may be changed at a later date, and that MIL&UN VERD reserves the right to change them without prior notice. Your continued use of the Website implies your acceptance of this along with your responsibility to review these Terms and Conditions.
As a user of the Website, you confirm you are can act on your own behalf and that you understand and accept all the Website's Terms and Conditions of Sale.
- PRODUCTS AND SERVICES
For the purposes of these Terms and Conditions, the business activity that MIL&UN VERD conducts through its Website includes the following: The sale of ARBOR SACRIS extra virgin olive oil from ancient olive trees and ARBOR SENIUM Farga-Morrut extra virgin olive oil blend. Both are sold in 250ml and 500ml bottles with packaging included.
- ACCESS BY USERS
By simply accessing the Website, you are deemed to be a user of it.
Using the website's services is at no charge and involves no commission or cost of any kind for accessing the site, with the exception of the costs of connecting via your selected telecommunications network provider, whose costs are to be borne by you.
Accessing via third-party applications (such as Facebook) means that security of access through this channel is the responsibility of those organisations. Likewise, the Website disclaims any direct or indirect responsibility for systems crashes or unavailability of the website or any similar situation.
- RULES REGARDING USE OF THE WEBSITE
The Website may only be used by persons aged 18 and over. By accessing, using or making purchases from the Website, you confirm and warrant that you are 18 or over and have the legal capacity to enter into contracts through this Website.
You are responsible for any content of yours that is published, including its veracity. MIL&UN VERD reserves the right to check all comments and/or opinions made by users before finally publishing them on the Website. You are solely responsible for any false, inaccurate or out-of-date statements made as well as for any damage caused in this regard to MIL&UN VERD or to third parties as a result of an infringement of this duty.
Responsibility for any content directly or indirectly published on the Website lies solely and exclusively with you and MIL&UN VERD disclaims any responsibility for its veracity. You understand and accept that MIL&UN VERD offers marketing services only for oils.
By using this Website, you agree that most communications with MIL&UN VERD will be done electronically (by email or notices posted on the Website).
For contractual purposes, you consent to using this electronic means of communication and acknowledge that all contracts, notifications, information and other communications that MIL&UN VERD sends electronically meet the legal requirement that they be in writing. Similarly, unless otherwise stipulated, MIL&UN VERD may contact and/or send you notifications via the email address or postal address you have provided.
You undertake to make reasonable use of the Website's services and to comply with MIL&UN VERD Terms and Conditions of Sale, and that MIL&UN VERD reserves the right to limit such use if it so wishes.
The Website is intended primarily for users who are resident in the European Union (EU). MIL&UN VERD does not warrant that the Website complies with the laws of other countries, either in full or in part. MIL&UN VERD declines any responsibility arising from such access.
The following are strictly forbidden:
- Using the MIL&UN VERD name for professional or lucrative purposes directly or indirectly.
- Using the MIL&UN VERD website for purposes other than obtaining olive oil and/or information about olive oil tourism.
- Making false or fraudulent purchases. If such a purchase could reasonably be deemed to have been made, it may be cancelled and the enforcing authorities informed.
- Publishing of offensive content, of any kind whether sexist, racist, defamatory and/or contrary to current legislation in Spain and the European Union.
- Defaming, abusing, harassing, annoying, threatening or violating others' legal rights, such as rights of privacy or publicity.
- Using the website for promotional purposes not expressly authorised by the MIL&UN VERD team or disseminating unauthorised advertising content.
- Impersonating another, with all the legal consequences that this entails.
- Disseminating, publishing or soliciting information that encourages the commission of any act that is unlawful in its jurisdiction - including, but not limited to: electronic fraud, spam, phishing, spoofing, forgery and any other type of conduct that is considered to be illegal.
- Making fraudulent use of the Website in any way.
- 5. INTELLECTUAL AND INDUSTRIAL PROPERTY
The Website is protected by intellectual and industrial property rights. These include, by way of example, but not limited to: the content, graphic design, source code, logos, text, graphics, illustrations, photographs and other elements that appear on the Website. You therefore recognise that the reproduction, distribution, marketing, transformation and in general any form of exploitation, using any procedure, of all or part of the Website constitutes an infringement of MIL&UN VERD's intellectual and industrial property rights (or of its owner) unless you have obtained prior express authorisation.
Any use outside of MIL&UN VERD, including the reproduction, modification, distribution, transmission, republication, rearrangement or representation of any elements thereof is strictly prohibited except with the express written consent of MIL&UN VERD.
You may not modify or use such intellectual and industrial property in such a way that its disclosure would be detrimental to MIL&UN VERD.
MIL&UN VERD will claim for any damages arising from the improper use by third parties of its intellectual and industrial property.
MIL&UN VERD does not grant any license or authorisation of use of any kind on its intellectual and industrial property rights or on any other right or property related to the Website, the services or contents.
- PURCHASING PROCESS
You can purchase products/services through the Website using the established means and forms.
Please follow miliunverd.com procedure for making online purchases, selecting the products and/or services you want, adding them to your shopping basket, and clicking on "Proceed to checkout".
You will also need to fill in and/or check the information that is requested at each step. Please note: you can change your purchase details up until payment is made.
During the purchase process, and in all cases before it is completed, you will be provided with full information about the final purchase price, including taxes. You are responsible for providing your details correctly, including personal and bank details as required by the system, in a true and accurate manner.
You will then receive an email confirming that MIL&UN VERD has received your order and/or request for service provision - that is to say, our confirmation of your order. Where applicable, you will also be sent an email giving the date on which your purchase is being dispatched. If appropriate, this information may also be shown in your personal user area within the Website. .
Once you have completed the purchase process, you consent to the Website generating an electronic invoice which will be sent to you by email. You may if you wish also obtain a paper copy of the invoice by requesting it from MIL&UN VERD using either the contact areas of the Website or the contact details provided above.
When making purchases, you acknowledge that you are aware of certain special conditions of sale in regard to the product and/or service in question, and which are displayed as part of its presentation or image, if applicable, on the Website page in question. Depending on each case, this includes but is not limited to: the name, price, components, weight, quantity, colour, product details or characteristics, the way in which they will be provided, and/or the cost of services. You further acknowledge that by placing your order you fully accept the special terms and conditions of sale that apply in each situation.
Purchases may be subject to security checks. The operation may be cancelled by MIL&UN VERD if it fails the checking process.
MIL&UN VERD shall not be liable where non-delivery of the products is as a result of the inaccuracy or falsity of the data you provide.
Any communications, purchase orders and payments involved in any transactions made via the Website may be stored and kept in computer records for the purposes of providing evidence of the transactions. Under all circumstances, reasonable security conditions shall be respected as well as any applicable relevant laws and regulations, and particularly in accordance with European Parliament and Council Regulation (EU) 2016/679 of 27 April 2016 regarding the protection of individuals in regard to processing personal data and the free movement of such data (GDPR) and the Data Protection and Guarantee of Digital Rights Act (Spain) 3/2018 of 5 December (LOPDGDD), as well as any applicable rights you may have as a user, in accordance with this Website's privacy policy.
6.1 Prices and payment
The prices displayed on the Website are the final prices, in euros (€), including taxes, unless otherwise stated and applied, due to a legal requirement, in particular in relation to VAT.
Shipping costs are included in the final prices of the products displayed on the Website. MIL&UN VERD fulfils its delivery and/or shipping services through the following companies: Correos, SEUR, UPS, TNT, GLS and Envialia, ASM and Salvat Logistics.
Under no circumstances will the Website automatically add additional costs to the price of a product or service, apart from those that you have voluntarily and freely selected and chosen.
Prices are subject to change at any time. However, any potential changes will not apply to orders or purchases for which you have already received an order confirmation.
Accepted forms of payment are: Credit or debit card, cash, bank transfer and PayPal.
MIL&UN VERD employs all measures to ensure the confidentiality and security of payment details you send as part of transactions made via the Website. As such, the Website uses a secure SSL (Secure Socket Layer) payment system.
Credit cards are subject to verification and authorisation by the issuing bank. If the bank does not authorise the payment, MIL&UN VERD shall not be responsible for any delay or non-delivery and will be unable to confirm your transaction.
When MIL&UN VERD has received your purchase request via the Website, a pre-authorisation will be made to the relevant card to ensure that there are sufficient funds to complete the transaction. The card will be charged at the point when the service confirmation is duly sent to you and, if applicable, the agreed place.
6.2 Delivery
Where the purchased goods need to be physically delivered, deliveries will be made within the following territory: European Union (EU).
Except in unforeseen or extraordinary circumstances, or where products are customised, the purchase order relating to the products listed in the purchase confirmation will be delivered within the period stated on the Website, depending on the delivery method you select, from the date on which the order is confirmed. Orders will be prepared at the point when payment has been confirmed and within the following times: Monday to Friday, 9am to 5pm. Orders placed outside the hours stated above will be prepared on the working day following that of the order confirmation and within a maximum of 7 calendar days from the date of the order confirmation.
No deliveries will be made on Saturdays, Sundays and/or holidays.
If, due to any reason attributable to MIL&UN VERD, we are unable to meet the delivery date, we will contact you to notify you of this and you will have the option of going ahead with the purchase and setting a new delivery date or cancelling the order, with a full refund of the price paid. Home deliveries are always made on working days of the week.
If it is not possible to deliver your order because you are not home, it may be returned to the warehouse. In this case, the delivery company will leave a note explaining the location of the order and how you need to arrange for it to be sent out for delivery again.
If you are not going to be at the delivery location at the agreed time, you will need to contact the delivery company to agree another day.
If 30 days after your order has been available for delivery, it has not been delivered for reasons not attributable to the delivery company, it will be assumed that you wish to withdraw from the agreement and it will therefore be deemed to be terminated. As a consequence of the contract being terminated, all payments received from you will be returned, with the exception of additional expenses resulting from the your own choice of a delivery method other than the least costly ordinary delivery method offered by the Website, without any undue delay and, regardless, within a maximum period of 14 calendar days from the date on which the contract is deemed to have been terminated.
However, you must bear in mind that the transport arising from such termination may have an additional cost that may be passed on to you.
For the purposes of these Terms and Conditions, delivery will be deemed to have taken place, or the order deemed to have been fulfilled, at the point when you or your nominated third party take actual possession of the products from the delivery company. This will be confirmed by signing for receipt of the order at the agreed delivery address.
From the point at which the goods are delivered, any product risks are borne by you. You take ownership of the products once MIL&UN VERD has received full payment for all amounts due (including delivery costs) in relation to your purchase, or at the time of delivery, if this is after full receipt of the amount due to be paid to MIL&UN VERD.
In accordance with Value Added Tax (VAT) Act (Spain) 37/1992, of 28 December, purchase orders for delivery and/or provision of service will be subject to Spanish VAT if the delivery address is within Spanish territory except for the Canary Islands, Ceuta and Melilla. The VAT rate applied shall be that which is legally in force from time to time, depending on the specific item in question.
- TECHNICAL MEASURES FOR CORRECTING ERRORS
If you spot an error when entering the details required for processing your order on the Website, you can correct this by contacting MIL&UN VERD via the appropriate contact area of the Website, and, if applicable, via the customer services contact channels and/or using the contact information given in Clause 1 above (General Information). This information can also be corrected in your personal user area within the Website.
In any event, before clicking on "CONFIRM ORDER", you can access your basket or area where your purchase requests are stored and make any relevant changes there.

- REMOVING AND OPTING OUT OF CONTENT
The Website may contain tools for you to interact. The comments you make under the areas of interaction reflect your opinion and not that of MIL&UN VERD, who is not responsible for any opinions published there.
MIL&UN VERD reserves the right to remove (ban) or modify any comment of any kind that it considers does not comply with the established rules and the correct functioning of the Website, and you hereby waive any claim against this.
- RETURNS
When you purchase products through our Website, you have a number of rights, as set out below:
The Right to Cancel
In accordance with Spanish legislation, customers have the right to cancel, allowing them to return a product they have received if it does not meet their expectations.
This right may be exercised within 14 calendar days from receipt. Due to the nature of the products sold on this website, as the purchaser if you wish to exercise your right to cancel, you must not open the product so that it remains fit for consumption.
Where you have opened the product, this right to cancel will not be applicable in accordance with the exclusions contained in Article 103 of Royal Decree (Spain) 1/2007 of 16 November approving the Revised Text of the General Consumer and User Protection Act (Spain) and other complementary laws amended by Article 28 of Act 3/2014 of 27 March, paragraph e.
Where it is MIL&UN VERD who handles the collection of the product being returned, once the condition of the goods has been checked, the refund for the purchase amount will be made via the same means of payment originally used to pay for the order and, in any case, within 14 calendar days from receipt of the request to cancel. Where it is the buyer who is returning the product using a carrier of their own choice, the 14-day refund period will start from the point when MIL&UN VERD is aware of the goods being dispatched or, failing that, from the time the product is received.
The costs of returning goods under the right to cancel are borne by the buyer.

To meet the permitted right-to-cancel period, simply notify us unequivocally of your decision to cancel before the end of the cooling-off period.
This right to cancel will not be applicable in accordance with the exclusions contained in Article 103 of Royal Decree (Spain) 1/2007 of 16 November, which approved the Revised Text of the General Consumer and User Protection Act (Spain) and other complementary legislation modified by Article 28 of Act 3/2014, of 27 March, under the following paragraphs:
- "the supply of goods which are liable to deteriorate or expire rapidly" (in accordance with Best Before Date)
- "the supply of sealed goods which are not eligible for return for health or hygiene reasons, and which have been unsealed after receipt".
Return of defective products or errors in shipping
These are any situations in which you consider that, at the time of delivery, the product does not comply with the agreement or purchase order, and you must therefore specify the reason for this return on the delivery note and return the product immediately to the delivery company.
Once the delivery company delivers the products returned by you to MIL&UN VERD, the products will be examined and you will be notified, within a reasonable period, whether a refund will be made or, where appropriate, a replacement sent to you.
The product will be refunded or replaced as soon as possible and, in any event, within 14 days from the date on which we send you an email confirming that the non-compliant product is being refunded or replaced.
The amount paid for products returned due to a confirmed defect will be fully reimbursed, including delivery costs and any costs you incur when returning the item(s). The refund will be made using the same payment method that you used to pay for the purchase.
We shall at all times respect any recognised legal rights that apply to you - both as a consumer and user of the Website.
General guarantees for all products
Unless proved otherwise, the goods shall be deemed to conform to the agreement, provided that they meet all the requirements set out below:
- They meet the seller's description and possess the qualities of the product that the seller has presented to consumers and users on the Website or in the form of a sample or model.
- They are suitable for the uses that products of a similar type are ordinarily intended.
- They present the usual levels of quality and performance of a product of the same type that consumers and users can reasonably expect, taking into account the nature of the product
The Consumer and User Protection Act (Spain) offers a two-year guarantee from the date of receipt of the product. However, this period will depend on the nature of the product itself, where the shelf life of the product (Best Before Date) is earlier than the guarantee period set by the Act.
- AVAILABILITY
All purchase orders received by MIL&UN VERD via the Website are subject to product availability and/or any circumstances or causes of force majeure (please see Clause 17 of these Terms and Conditions) that may affect the supply of the products and/or services.
If there are any issues regarding the availability of the products/services purchased, MIL&UN VERD undertakes to contact you and refund any amount you have paid. This shall also apply in cases where providing a service becomes unfeasible.
- REPORTING INFRINGEMENTS
If you infringe intellectual and/or industrial property rights or any other third parties' rights, you will be warned by MIL&UN VERD at the time it becomes aware of such infringements to cease publication of the infringing content. In this case, you will be liable for such infringements.
If any person or entity considers that the content published on the Website infringes their rights to honour, privacy, image or any other right, they may communicate this to MIL&UN VERD by any of the means of contact listed on the Website including as the subject matter "Infringement of Rights", requesting that it be removed and provide the following information:
MIL&UN VERD will deal with the request and if it considers that the person or organisation has provided justified reasons or grounds for requesting the withdrawal of such content, it will proceed immediately to remove it from the Website so that it is not accessible to users, even from the cache memory.

- identification of the content that allegedly infringes the rights in question, along with reasonably sufficient information to enable MIL&UN VERD to locate such material on the Website,

- OBLIGATIONS AND WARRANTIES
- To ensure the Website meets the requirements and functionality in order to fulfil the purpose stated in Section 2 of these Terms and Conditions of Sale.
- That it will make best efforts to ensure the excellent operation of the Website. MIL&UN VERD therefore undertakes to diligently process any claims or complaints from users or third parties that may have involved some type of irregularity.
- To use best efforts to ensure the security and availability of information hosted on their servers.
- To provide users with the information they require in relation to accessing and using the Website.
- To ensure the proper functioning of the Website.
- To diligently carry out any necessary tasks for the proper management and operation of the Website.
- PRIVACY
As the data controller for the data included on the Website, MIL&UN VERD will process all information entered onto the Website in accordance with the Privacy Policy on the miliunverd.com website, and as stated in the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Protection of Personal Data and Guarantee of Digital Rights Act (Spain) 3/2018.

- DURATION AND TERM
These Terms and Conditions of Sale will come into force at the point that you access the Website and will remain in force indefinitely, as long as you access the Website.
- WAIVER
Where MIL&UN VERD waives a specific legal right or legal action or does not require your strict compliance with any of its obligations, this shall in no way constitute a waiver of other rights or legal actions arising from a contract or these Terms and Conditions. Nor shall it exonerate you from complying with your obligations. Where MIL&UN VERD waives any of these Terms and Conditions or any rights or legal actions arising from a contract, these shall not be effective unless expressly stated to be a waiver and formally communicated to you in writing.
- NULLITY
- FULL AGREEMENT
These Terms and Conditions along with any document expressly referred to within them, constitute the full agreement between you and MIL&UN VERD in regard to the sale. They replace any other agreement, arrangement or previous promise agreed verbally or in writing by both parties.
You and MIL&UN VERD both acknowledge that you have consented to enter into an agreement without having relied on any statement or promise by the other party - except as expressly referred to in these Terms and Conditions.
- COMPENSATION
You agree to indemnify, defend in court and exonerate MIL&UN VERD from all liability in the event of any claims made by third parties, brought on the basis of, or arising from, you accessing MIL&UN VERD's Website and any use made of it, the information provided or your breach of these terms and conditions.
- LIABILITY WAIVER
Unless otherwise legally provided for, MIL&UN VERD accepts no responsibility for the following losses, regardless of their origin:
- any losses that are not attributable to a breach on its part;
- Business losses (including business interruption, loss of revenue, loss of contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred); or
- Any other indirect loss not reasonably foreseeable by both parties at the time the agreement for the sale of the products was entered into between them.
MIL&UN VERD's liability is also limited in the following situations:
- MIL&UN VERD applies all appropriate measures in order to truthfully and accurately display the product on its Website. However, it is not liable for any minimal differences or inaccuracies that may exist due to lack of resolution on the computer screen, or problems relating to the browser used or other issues of this nature.
- MIL&UN VERD will make best endeavours to ensure the products purchased are made available to the delivery company. However, it is not responsible for losses arising from a malfunction during transportation, especially for reasons such as strikes, traffic jams, and in general any other issue that is typical of the sector, and which results in delays, losses or theft of the product.
- Technical failures, whether due to accident or other reason, that prevent the normal operation of the service over the internet. Lack of availability of the Website due to maintenance or other reasons, which prevents the service from being available. MIL&UN VERD makes all its resources available for carrying out the process of purchasing, payment and shipping/delivery of its products. However, it is not responsible for causes which are not attributable to it, or for unforeseeable circumstances or force majeure.
- MIL&UN VERD will not be responsible for the improper use and/or wear and tear of any products that you have used. Nor shall MIL&UN VERD be responsible for erroneous returns made by you. It is your responsibility to return the correct product.
- MIL&UN VERD shall not be liable for any damages arising from the use of the Website, or for any action taken on the basis of the information provided therein.
- MIL&UN VERD shall not be liable for potential security errors or disconnections that may occur or for any damage that may be caused to your computer system (hardware and software), files or documents stored therein, as a result of a virus in the computer you use to connect to the Website, or for the malfunctioning of your browser or due to the use of non-updated browser versions.
In general, MIL&UN VERD shall not be liable for any failure or delay in meeting any of its obligations where this is due to events beyond its reasonable control - that is, due to reasons of force majeure, including but not limited to the following:
- Strikes, lockouts or other forms of industrial action.
- Civil commotion, revolt, invasion, terrorist threat or attack, war (whether declared or undeclared) or threat of or preparations for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
- Inability to use trains, ships, planes, motor transport or other means of transport, whether public or private.
- Inability to use public or private telecommunications systems.
- Acts, decrees, legislation, regulations or restrictions imposed by any government or public authority.
The obligations will therefore be suspended for as long as the cause of force majeure continues, and MIL&UN VERD shall be given an extension to its period for meeting its obligations that is equal to the duration of the cause of force majeure. Despite the cause of force majeure, MIL&UN VERD shall make all reasonable resources available to find a solution that will enable it to comply with its obligations.
- LIABILITY AND LIMITATION OF LIABILITY FOR LINKS FROM OTHER WEBSITES
